Please read these terms before using this site.
Use of the site indicates that you agree to be bound by the terms.
The agreement
These terms and conditions apply to all users of this site, and those handling any images or other content obtained from the site.
These terms supersede any previous terms and conditions and can be changed by Animal Photography at any time.
Ownership
The site and its content belong to Animal Photography and its image suppliers.
The Images are the property of Animal Photography and its contributors. Using images from this site or from the Animal Photography picture library does not confer any right title or interest in the images except as specifically set out in the licence agreement.
Usage Rights
Low resolution images may be downloaded from the site for viewing purposes only.
You agree that you will not authorise or permit any other use of the images except as specified in the licence to use.
Copyright and credit
The images are protected by copyright under UK law.
You must credit images on each usage in the format © Animal Photography/photographer. If you fail to credit an image an additional fee of 50% of the original licence fee will be payable.
Images shall not be altered or manipulated, added to, or have any part deleted without our prior written consent.
Image supply
We take every care to supply images in compliance with industry standards, as detailed on our supply form. However, the final format and quality of image output is the responsibility of the customer.
We will presume the image files have arrived in good usable condition unless notified within 5 business days of delivery.
Image Storage
Images may be stored on electronic media for the duration of the project for which the images have been purchased, and for use only as specified in the licence provided.
Metadata
Images must be stored with metadata intact; that is with caption, credit, picture number, copyright notice, instructions, and any other information supplied in the image file.
Reproduction rights
Reproduction of our images is only allowed with express written permission. This includes use in projection, artist’s reference, and presentation.
Reproduction rights are not granted upon delivery of the images. The rights arise when licence terms are agreed, and on full payment of the invoice.
Reproduction rights are subject to these terms and conditions and any terms and conditions set out in the delivery note and licence.
Reproduction rights may not be assigned to a third party.
Rights granted do not include the right to use the material for publicity purposes unless agreed in writing.
Penalty Fees and Interest
Any image reproduced without payment of invoice constitutes infringement of copyright. In the event of copyright infringement, you will be liable for payment of a penalty fee and damages.
In the absence of any written agreement to extend the payment period, non payment of an invoice entitles us to rescind the licence.
If payment is not made by the due date, we reserve the right to charge interest at the rate prescribed by the Late Payment of Commercial Dents ((Interest) Act 1998.
Permissions
You are responsible for obtaining all necessary rights, model releases and consents required for reproduction.
No model release exists for images on the site except where specified in writing by ourselves.
While we take reasonable care in the peformance of this agreement, we make no warranty covering the use of trademarks, people, or copyright material in reproduced images. We shall not be liable for any loss or damage to you or any third party arising from the use or reproduction of an image or its caption.
You may not
a) Alter or merge an image to create a derivative work without permission
b) Use the image in any way which is defamatory or pornographic
c) Store or transmit the image in any way other than that provided by the licence to use
Termination
Any licence will be terminated if you a) die b) enter into voluntary or compulsory liquidation c) have a receiver appointed or d) fail to perform any of your obligations under these terms and conditions within 28 days of our giving you notice to comply. In the event of termination, all rights granted will immediately revert to us, and any further exploitation of any image will constitute an infringement of copyright.
Law and disputes
These Terms and Conditions are governed by the laws of England and Wales subject to the exclusive jurisdiction of the English courts, except for infringement of copyright or non payment of our invoices where jurisdiction will be non-exclusive.
